AREAS OF PRACTICE

Annie Verdries is Chair of the firm-wide Bankruptcy and insolvency group.  She has more than 25 years of experience in the Bankruptcy and insolvency field.  She has represented debtors, creditors, lenders and trustees in connection with Chapter 7, 11 and 12 and 13 cases.  She has handled complex bankruptcy cases and has proposed and confirmed Chapter 11 plans for debtors-in-possession and Chapter 11 trustees.  She has also represented receivers, Plan Disbursement Agents and parties in work-out proceedings.

Advising Creditors, Debtors and Trustees

• Advising and representing  trustees, receivers, debtors, creditors (secured and unsecured) creditor's committees and shareholders
• Render advise on state receiverships, conservatorships, and insolvency proceedings under state and federal law
• Representation regarding use of cash collateral, adequate protection, assumption and assignment of executory contracts, unexpired leases and other business, commercial and real estate issues related to bankruptcy law, automatic stay litigation, plan confirmation
• Advise indenture trustees in connection with reorganization of publicly held corporations
• Represent Chapter 13 standing trustee
• Represent creditors committees, individual creditors and parties acquiring bankrupt companies
• Representation in corporate and partnership reorganization
• Representation in corporate, partnership and individual bankruptcy
• Advise creditors, shareholders, purchasers regarding application of avoidable transfer principals to all manner of corporate financing and acquisitions and litigation of such claims in the bankruptcy court and elsewhere
• Pre bankruptcy planning and advice

Workouts

• Loan workouts and debtor in possession financing on behalf of creditors and debtors
• Supplier and customer rehabilitations and workouts
• Analyzing and documenting non-judicial arrangements, extensions and other "workouts" among creditors and debtors  
• Advise secured and unsecured creditors in preserving and enforcing their interests under the Uniform Commercial Code   and United States Bankruptcy Codes
• Restructuring debt to avoid bankruptcy and advice regarding alternatives to bankruptcy
